The Corporate Battle Over the Cable News Network Shows The Extent to Which Flawed US Journalism Now Is.

This past Thursday night, as rumors swirled regarding an incident at Brown University, the network's Kaitlan Collins used social media, noting the confusion and guiding the public to her network’s 9pm newscast.

Even though CNN is certainly not a perfect news source, her message seemed accurate for numerous observers. It remains one of the broadcasters where there exists fact-based and largely trustworthy reporting – notably during fast-moving events like the one taking place near a New Hampshire storage facility.

An Uncertain State During a Business Battle

Yet CNN, now 45 years old, finds itself in a uncertain situation as two huge media empires battle over ownership of its corporate owner, Warner Bros Discovery.

Regardless of who wins, the future of CNN has turned into a high-risk game of mergers and acquisitions, instead of as a question of what benefits the news-consuming public.

“This represents another instance of the fundamental flaws with roots in decades of governmental choices,” noted Victor Pickard, author of “Democracy Without Journalism?” and a media policy professor at the Pennsylvania University.

The speculation about which company will control Warner Bros Discovery – could it be Netflix or Paramount Skydance? – overlooks a more important point.

“It gets presented as a corporate drama with powerful individuals as the protagonists, but there is hardly any discussion of the common good,” Pickard added.

A Further Element: Donald Trump

The network's predicament is made more complex by Donald Trump’s views about a network he has frequently denounced as perhaps his chief “fake news” foe.

Recall the cries of “CNN sucks!” at his rallies, his administration's retaliatory suspension of reporter Jim Acosta’s press credentials, or his sparring with Collins in press briefings.

Trump now says that CNN needs new ownership. Many see this as a desire for ownership that will shield him from journalistic oversight. That is a factor in why he seems to come down on the side of Paramount Skydance, which has made a unsolicited offer.

Trump has reason to prefer that company more. For one thing, it is controlled by David Ellison, son of the Trump-friendly Larry Ellison, one of the world’s richest people.

The company, parent of CBS News, also recently appointed the right-leaning Bari Weiss, famous for her “anti-woke” beliefs, as the lead editor of that venerable news network.

An Outcome of Continued Instability

Notably, if Netflix wins, CNN and other cable outlets would first be spun off into a separate entity. This might be a welcome development to many at the network, but it’s far from a guarantee of stability. That setup could pave the way for CNN for yet another acquisition. There is no finish line.

If you ask Timothy Wu, a great deal of this is a violation of antitrust statutes, anyway. The well-known analyst of big tech’s dominance recently argued that competition laws should disallow both deals.

“Either merger would be bad for the country, and both should be opposed by anti-trust authorities,” Wu argued.

The Fundamental Challenge and a Path Forward

Whatever happens in this situation, the underlying crisis persists.

“Our current system is a highly system hostile to democracy, but we must resist learned helplessness,” Pickard said. Policy decisions – originating in the 1930s and 1940s – helped to create this overly commercial monster, and revised policy decisions can tackle it.

Will that happen in an era where the Federal Communications Commission chair won’t even affirm that the agency is independent? Change is highly improbable now, but that is not to say it will not happen in the future.

Policies that support independent news organizations, bolster local journalism, finance public media, and outlaw the consolidation of media power in a handful of hands are achievable – they are necessary for a healthy democracy.

Regarding media ownership, bigger isn’t better. And news organizations like CNN shouldn’t be tools in the newest acquisition battle.
